on an Ordinance entitled An Ordinance for more

effectually preventing the Publication of Obscene

Books, Pictures, and other Articles.

1/- The object of this Ordinance is to introduce into the Colony the

provisions of the Obscene Publications Act, 1857, 20 and 21 Vict.c. 83,

which empowers Magistrates and Justices of the Peace to issue warrante

to search for obscene books, pictures and other articles, and, after

giving parties who may be interested an opportunity of being heard,

to order the destruction of any obscene articles so seized. The

absence of any such power in this Colony was felt in a recent case.

2/- Section 1 is formal

Section 2 is founded on part of Section 1 of the obscene Publica-

tions Act.

Section 3 defines the powers of an officer executing a warrent

under the Ordinance.

Section 4 is founded on part of Section 1 of the Ordinance.

3/ In my opinion this is an Ordinance to which His Excellency the

Governor may properly assent in the name of His Majesty and on His

behalf.
